PBG harus dimiliki bagi setiap orang sebelum pelaksanaan konstruksi, baik untuk membangun bangunan gedung atau prasarana bangunan gedung baru, mengubah, memperluas, mengurangi, dan\/atau merawat bangunan gedung atau prasarana bangunan gedung.<\/span><\/p>\n

Namun bagaimana kalau pemilik bangunan gedung tidak memenuhi kewajiban persyaratan perizinan, dalam hal ini PBG.<\/span><\/p>\n

Setiap pemilik bangunan gedung, penyedia jasa konstruksi, profesi ahli, penilik, pengkaji teknis, dan\/atau pengguna bangunan gedung pemilik dan\/atau pengguna yang tidak memenuhi kewajiban pemenuhan fungsi, dan\/atau persyaratan, dan\/atau penyelenggaraan bangunan gedung dikenai sanksi administratif.<\/span><\/p>\n

Sanksi administratif ini diatur dalam Pasal 24 angka 42 Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja yang mengubah Pasal 45 ayat (1) Undang-Undang Nomor 28 Tahun 2002 tentang Bangunan Gedung.<\/span><\/p>\n

    Ketentuan lebih lanjut mengenai kriteria, jenis, besaran dan tata cara pengenaan sanksi administratif di atas diatur dalam Peraturan Pemerintah. Namun sampai artikel ini ditulis, belum diundangkan Peraturan Pemerintah yang mengatur ketentuan mengenai ini.<\/span><\/p>\n

    Selain itu, terdapat sanksi pidana dan denda juga apabila tidak dipenuhinya ketentuan dalam UU Bangunan Gedung <\/span>jo<\/span><\/i>. UU Cipta Kerja, jika karenanya mengakibatkan kerugian harta benda orang lain, kecelakaan bagi orang lain yang mengakibatkan cacat seumur hidup, atau hilangnya nyawa orang lain.<\/span><\/p>\n

    Kita selaku anggota masyarakat juga bisa melaporkan secara tertulis kepada Pemerintah Pusat dan\/atau Pemerintah Daerah kabupaten\/kota terhadap:<\/span><\/p>\n

    1. indikasi bangunan gedung yang tidak laik fungsi; dan\/atau<\/span><\/p>\n

    2. bangunan gedung yang pembangunan, pemanfaatan, pelestarian, dan\/atau pembongkaran berpotensi menimbulkan gangguan dan\/atau bahaya bagi pengguna, masyarakat, dan lingkungannya.<\/span><\/p>\n

    Kemudian, bagaimana kalau banguan tersebut sudah terlanjur berdiri tapi belum memiliki PBG. Maka untuk memperoleh PBG, harus mengurus Sertifikat Laik Fungsi (SLF) berdasarkan ketentuan Peraturan Pemerintah Nomor 16 Tahun 2021 tentang Peraturan Pelaksanaan Undang-Undang Nomor 28 Tahun 2002 tentang Bangunan Gedung.<\/span><\/p>\n

    Dapat ditarik kesimpulan jika kewajiban dalam setiap pembangunan bangunan gedung harus dilengkapi dengan PBG. Hal ini berlaku bagi setiap orang dan tidak ada pengecualian tertentu untuk\u00a0 siapa saja, sekalipun sudah terlanjur membangun tanpa adanya PBG.<\/span><\/p>\n
