\u201cPasal 144 ayat (1) UU Cipta Kerja menjadi dasar atas kepemilikan satuan rumah susun bagi WNA\u201d<\/p><\/blockquote>\n

WNA punya apartemen di Indonesia? kok bisa?<\/p>\n

Upaya untuk mendongkrak industri properti yang terpuruk beberapa tahun belakangan ini, membuat pemerintah menggodok dan menuangkannya potensi-potensi investasi dalam\u00a0omnibus law<\/em>\u00a0cipta kerja pada tahun 2020.<\/p>\n

Pemberian Hak Milik kepada WNA memang merupakan suatu hal yang baru karena sebelumnya pemberian hak yang diberikan kepada WNA hanya sebatas pada hak pakai. Hak pakai atas satuan rumah susun sebelumnya diatur dalam Pasal 5 Peraturan Pemerintah No. 103 Tahun 2015 tentang Pemilikan Rumah Tempat Tinggal atau Hunian oleh Orang Asing yang berkedudukan di Indonesia sedangkan dalam UU Cipta Kerja, hak milik atas satuan rumah susun diatur dalam Pasal 143-145.<\/p>\n

Mengacu pada Pasal 143 UU Cipta Kerja, hak milik atas satuan rumah susun merupakan:<\/p>\n

\u201chak kepemilikan atas satuan rumah susun yang bersifat perseorangan yang terpisah dengan hak bersama atas bagian bersama, benda bersama, dan tanah bersama<\/em>\u201d.<\/p><\/blockquote>\n

Yang mendasari hak kepemilikan Asing atas satuan rumah susun tersebut secara lebih lanjut diatur dalam pasal 144 yang berbunyi:<\/p>\n

1. Hak milik atas satuan rumah susun dapat diberikan kepada:<\/p>\n

    \n
  1. warga negara Indonesia;<\/li>\n
  2. badan hukum Indonesia;<\/li>\n
  3. warga negara asing yang mempunyai izin sesuai ketentuan peraturan perundang-undangan;<\/li>\n
  4. badan hukum asing yang mempunyai perwakilan di Indonesia; atau<\/li>\n
  5. perwakilan negara asing dan lembaga internasional yang berada atau mempunyai perwakilan di Indonesia<\/li>\n<\/ol>\n

    2. Hak milik atas satuan rumah susun dapat beralih atau dialihkan dan dijaminkan.<\/p>\n

    3. Hak milik atas satuan rumah susun dapat dijaminkan dengan dibebani hak tanggungan sesuai dengan ketentuan peraturan perundang-undangan.<\/p>\n

    Menurut Ali Tranghanda, pengamat properti dan CEO\u00a0Indonesia Property Watch<\/em>\u00a0(IPW) mengemukakan bahwa\u00a0omnibus law<\/em>\u00a0cipta kerja ini hanya menyederhanakan ketentuan kepemilikan Asing atas properti rumah susun meski dampaknya mungkin tidak akan signifikan.<\/p><\/blockquote>\n

    Pergeseran paradigma ini harapannya mampu untuk merubah keterpurukan serius yang menimpa industri properti di Indonesia. Karena sejak sebelum disahkannya Undang-Undang ini banyak investor yang mencari properti di Asia dan memilih Singapure atau Malaysia karena dianggap lebih aman.<\/p>\n

    Disamping itu, Menteri Agraria dan Tata Ruang, Sofyan Djalil, menegaskan bahwa selain untuk memompa industri properti di Indonesia, pemberian hak milik kepada Asing juga tidak melanggar ketentuan yang ada dalam\u00a0UU Pokok Agraria. Hal ini karena rumah susun berbeda dengan rumah tapak atau\u00a0landed house<\/em>.<\/p>\n

    Jadi maksud dari pemberian hak milik ini yakni kepemilikan ruang bukan kepemilikan tanah karena kepemilikan tanah dalam rumah susun merupakan hak kepemilikan tanah bersama.<\/p>\n
